COD Seeks Clarification on Previous Court Ruling

College officials believe the Village of Glen Ellyn wrongly interpreted a previous ruling, which the college says is costing them thousands of dollars.

Today,  will be in court seeking clarification of Judge Terrence Sheen's previous opinion regarding jurisdiction on the 273-acre campus in Glen Ellyn. 

Village and college officials disagreed on the Nov. 8 ruling, each interpreting the opinion differently, which COD officials say is costing them money and delaying time-sensitive projects. 

COD wants the court to clearly define each groups' rights moving forward. COD contends that the village retroactively applied its interpretation of the ruling, issuing stop work orders and demanding the college pay outstanding inspection fees totaling $35,960.59, according to the motion.

"We're asking for greater clarification of the judge's ruling, and to also note that it was not intended to have any affect on current construction projects," said Joe Moore, COD spokesperson. 

After Judge Sheen's Nov. 8 ruling, the village began to apply its local ordinances to new construction projects, which Village President Mark Pfefferman said college officials knew would happen. Pfefferman said the village "bent over backwards" and gave the school two weeks notice to comply with local ordinances at the job sites before issuing stop work orders on Dec. 1.

One day before issuing the stop work orders, COD's Board of Trustees with Glen Ellyn to begin de-annexation. According to Moore, the college will try to become a part of unincorporated DuPage County. 

It's unclear if a more clearly defined decision will be made during today's court hearing. Stay tuned to Patch for more details.
