Man Convicted of Hitting Pregnant Wife Wants to Take Back Plea

Eric Rego calls requirement that he serves 85 percent of prison term a "mistake."

When , he thought his deal with prosecutors meant he’d serve only five years of the 10-year prison sentence he received.

When Rego – formerly of Glen Ellyn – learned from Illinois Department of Corrections officials that he was actually required to serve 8 and a half years, he sent a letter to DuPage County seeking to back out of his agreement, court documents show.

“I only pled [sic] guilty because of the agreed upon 50 percent stipulation,” Rego states in a hand-written letter sent from the Lawrence Correctional Center. “This mistake has me serving an extra three or four years.”

Rego, 36, appeared in court on Nov. 30 to admit he punched his pregnant wife, Anne, in the face during a May altercation that ended after Eric . A copy of the sentencing order shows a conviction for the class 2 felony and an accompanying 10-year prison sentence, court records state.

However, a line used to indicate what percentage of the sentence Rego must serve is not checked off. Court records show Rego inquired of prison officials about his “out date” or projected release date, which is when he learned aggravated domestic battery convictions now require at least 85 percent of the sentence to be served.

He’s currently expected to be released in 2019, according to IDOC. Rego’s letter was received Dec. 27, within the time allowed for a defendant to withdraw a plea. Rego was scheduled for a Tuesday hearing, but records also show a hearing scheduled for Feb. 6.

Rego’s wife is also in prison after in November. She is scheduled for parole in 2017.
