Court Watch: Downers Man Pleaded to Swindling, Australian Posts Bond in St. Charles Sex Assault

A look back at recent court dispositions in DuPage and Kane counties.

DUPAGE COUNTY

Downers Grove:

A 51-year-old man, who last lived in Downers Grove, recently pleaded guilty to swindling money from an elderly resident.

Metlow Miller admitted to one count of aggravated home repair fraud in connection to an April encounter with an 83-year-old man. Miller told the man he would fix cracks in his driveway and sidewalk for $32, but then told the man it would case nearly $1,300.

The man paid Miller $950, although no work was performed. Miller received 180 days in DuPage County Jail, 24 months of probation and was ordered to pay restitution, as well as $650 in court costs.

A DuPage County grand jury has indicted a 24-year-old Chicago man on charges he held up a gas station on Sept. 13.

Mario Williams remains in DuPage County Jail on $300,000 bail charged with armed robbery and aggravated robbery. Police previously said Williams used a semi-automatic handgun while demanding cash from an employee of the Shell Station in the 900 block of North York Road.

Williams was captured after he tried to flee by taking a taxi out of the area. Williams returns to court Oct. 25 when he could be arraigned on the charges.

Hinsdale:

Prosecutors in the case of Juan Cuellar, the 23-year-old Willowbrook man accused of shooting to death Hinsdale South graduate Joshua Holmes, have filed paperwork stating they will give immunity to two witnesses who might not otherwise testify to what they know about the killing, court records show.

The witnesses, both identified as women, would likely refuse to testify or "produce evidence" for fear of self-incrimination without immunity protection, prosecutors stated in the court filing.

Records do not elaborate on the content of their potential testimony.

Cuellar remains in DuPage County Jail without bond. He is scheduled for an Oct. 22 hearing.

Cuellar's mother, Elva Hernandez, is also scheduled to appear in court the same day on an obstruction of justice charge. Prosecutors allege she concealed the gun Cuellar used in the shooting. Hernandez has filed a speedy trial demand in her case.

KANE COUNTY

St. Charles:

An Australian native charged with sexually assaulting woman in St. Charles has posted bond and is expected to live in Connecticut while awaiting trial.

Jefry Sutjito was arrested earlier this month after a woman accused him of the assault while the pair were at the Q Center for a month-long training event. Sutjito was released from Kane County Jail on Oct. 9 after his brother posted $50,000.

At a hearing later that week, Sutjito, who has no connections to Illinois was granted permission to live with his brother out of state while the case is ongoing. He is scheduled for a Nov. 1 hearing.
